Maritime law and the Jones Act

Injured seamen (a broad category including employees working on a cruise ship, ferry, harbor boat, tugboat, barge or other commercial vessel) are able, under maritime law and the Jones Act, to file injury claims in federal courts. The Jones Act provides for maintenance and cure for any injured seaman (medical and living expenses during recovery from an injury). In a case where the ship's owner, the captain or another employee of the shipping company was negligent in a way that caused the injury, the seaman may also sue for damages.

The Longshore and Harbor Workers' Compensation Act

Where maritime law and the Jones Act cover accidental injuries suffered at sea, the Longshore and Harbor Workers' Compensation Act (LHWCA) provides compensation for those injured while engaged in loading or unloading vessels, or in the construction or repair of ships.
