On October 28, 2008, the Appellate Division of the Second Department found in favor of Bosco, Bisignano & Mascolo, Esqs's. client in a case that initially seemed hopeless. The driver of truck was involved in an accident with a hit and run vehicle while on the Gowanus Expressway in Brooklyn. The accident threw the driver out of the cab of the truck, over the guardrail and down to the street many, many feet below. The hit and run vehicle escaped leaving the truck driver with devastating injuries.
He turned to Bosco, Bisignano & Mascolo, Esqs. for help. Anthony Bisignano of BBM decided to go after the truck's uninsured motorist policy that protects the occupants of motor vehicles involved in hit and run accidents. However, the Insurance Company that wrote the uninsured motorist coverage raised the defense that the driver was not wearing a seatbelt and, if, he had been wearing a seatbelt, the driver would not have been ejected from the cab of the truck. Bisignano overcame the defense and obtained a sizable $700,000.00 award for his client. The insurance company appealed the arbitrator's award and Bisignano again beat the Insurance Company.
